Suffern Man Critical After Crash, N.J. Man Charged With Assault, DWI

Attorney James Abate comments on news item in www.Lohud.com about Suffern man who was in critical condition after being hit by a truck in Mahwah, New Jersey. The driver has been charged with assault and DWI.

I am often asked, how can I prevent being charged for driving while intoxicated. The simple answer is do not get behind the wheel after you have been drinking.  There are a number of options that a driver has.  You can call a cab. You can get a ride from a friend.  You can call a family member.

As a parent, I can promise you that your family would rather wake up and get you than find themselves in the situation that this mans family finds themselves.  Borrowing money for bail and lawyers and facing incarceration.  One way to keep yourself out of a situation like this is to know the penalties. Even if you do not kill yourself or another, you face a loss of your license for up to a year for a first offense; two years for a second offense and for ten years on a third offense along with six months mandatory jail time.

The New Jersey legislature has been evaluating the use of an ignition interlock system for drivers who have been convicted of driving while intoxicated.  The controversy exists around plans to eliminate a license suspension.
