- Call the police. Contact local law enforcement as soon as possible if you have been involved in a motor vehicle collision. You will face criminal charges if the other party has been seriously harmed and you fail to report your involvement in the accident.
- Stay at the scene of the accident. Leaving the scene of an accident before the police say you can is punishable by New Jersey law. Even if the collision was not your fault, you want to make sure you are in full compliance with the law during this crucial time. A hit and run accident can result in a two or eight point ticket depending on whether anyone was injured. You may also be given a ticket for $85 or $140 depending on the location of the accident. Fleeing from a particularly severe accident is considered a felony.
- Gather witness information. Having the names of those who can attest to the circumstances surrounding your accident may be beneficial if the other party attempts to sue for injuries or damages sustained to their personal property. These witnesses may also be able to testify as to whether you or the other party involved in your accident was driving safely or recklessly.
- Obtain a copy of the police report. The officer who responds to the scene of your accident is obligated to file a report containing an account of the accident. This report may hold useful information should you have to go to criminal court.
